The York County Board of Commissioners met according to law on Tuesday, April 1, 2014 at 8:30 a.m. as per notice in the York News Times on March 27, 2014, with Chairman Bill Bamesberger presiding, with Tom Shellington and Paul Buller. 

 

The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

RESOLUTION #14-20        

 

WHEREAS, on the 28th day of May, 2002, the York County Board of Commissioners adopted Resolution #17; and

 

WHEREAS, the York County attempted to vacate the county road running from the South end of the Rotary Camp, so that the road would revert to the adjacent landowner, Doug Smith, that resolution #17 was not legally possible.

 

NOW, THEREFORE, BE IT RESOLVED, by the York County Board of Commissioners, to Resend Resolution#17

The York County Board of Commissioners met at their regular meeting on the 28th day of May 2002, to hold a public hearing as provided for in Neb. Rev Stat. 39-1722, R.R.S. 1943, as

 

WHEREAS, published notice was given in a newspaper of general circulation, published once each week for three (3) consecutive weeks, prior to this hearing; and

 

WHEREAS, public comment was received regarding the York County Highway Superintendent’s recommendation that the County of York abandon the following public road right-of-way located at the following described property:

 

            The public road running south between Section Seven (7) Township Nine (9) North,  range One (1)                         and Section Twelve (12), West of the 6th P.M., York County, Nebraska

 

NOW, THEREFORE BE IT RESOLVED THAT the York County Board of Commissioners finds it to be in the best interest to vacate and abandon the county road described as follows, to-wit:

 

            The public road running south between Section Seven (7) Township Nine (9) North, Range One (1)                         and Section Twelve (12) Township Nine (9) North, Range Two (2), West of the 6th P.M., York                           County, Nebraska

 

And the land so abandoned be returned to the titled owners of the adjacent real estate, one-half on each side thereof.

                                                RESOLUTION #14-21

           

The York County Board of Commissioners met at their regular meeting on the 1st day of April, 2014, to discuss and act on disposition of the Rotary Camp.

 

            WHEREAS, in June 2002, the County purchased the Rotary Camp property from John Kohl for $10,000.00. The deed filed in 2002 had the wrong grantor’s name, so a corrective deed to the same property was filed in 2008.  No deeds to the Rotary Camp were filed after 2008.  The County is still the recorded owner to the Rotary Camp.

 

            WHEREAS, on May 28, 2002, the County attempted to vacate the county road running south between Section 7, Township 9 North, Range 1, and Section 12, Township 9 North, Range 2, and through the Rotary Camp, so that the road would revert to the adjacent landowner, Doug Smith.  That was Resolution NO.  2002-17. it turns out, that Resolution was not legally possible, and should be rescinded.

           

            WHEREAS,  on June 24, 2003 the county board took bids at  public auction for “a tract of land located in the NW4 of Section 7 in West Blue Township and in the NE4 of Section 12 in McFadden Township”, which is the Rotary Camp.  Max Smith bid $1.00 and Pat Swantek bid $100.00.  The board voted to accept Max Smith’s bid because “the tract of land is adjacent to his property”.

 

            NOW, THEREFORE BE IT RESOLVED THAT, the York County Board of Commissioners find it to be in the best interest that this said property to be Deeded to Mr. Max Smith, described as follows,

 

A part of the Northwest Quarter (NW1/4) of Section Seven (7), Township Nine (9) North, Range One (1) West of the 6th P.M. and a part of the Northeast Quarter (NE1/4) of Section Twelve (12), in Township Nine (9) North, Range Two (2) West of the 6th P.M., all in York County, Nebraska, more particularly described in Official York County Survey, Instrument Number 2009-01048, recorded in Irregular Tract Survey Book 5, pages 262-265, filed on April 16, 2009, as follows:

            Moved by Buller, seconded by Shellington to adopt Resolution #14-22 to approve reappointing Paula Harris to the Visitors Bureau Board, Bulgrin and Sikes absent motion carried. 3-0

RESOLUTION #14-22

 

WHEREAS, the Visitors Bureau Board has requested the reappointment of a member to its Board; and

 

WHEREAS, current board members, Paula Harris has agreed to be reappointed for another 4 years; and

 

NOW, THEREFORE BE IT RESOLVED, that as of April 1, 2014, Paula Harris hereby reappointment to another four (4) year term which will expires April 1, 2018.

 Dave Merrill and C.J. Johnson from Region V Systems and Region V Services met with the Board of Commissioners to give Annual Report.

 

The Commissioners conducted there quarterly jail visit.

 

Committee reports were given.

 

The Chairman declared the meeting adjourned at 10:54 a.m.  The next meeting will be held April 15, 2014 at 8:30 a.m. in the County Commissioners Room, lower level of the Courthouse for the regular meeting.
