The York County Board of Commissioners met according to law on Tuesday, June 24, 2014 at 8:30 a.m. as per notice in the York News Times on June 19, 2014, with Chairman Bill Bamesberger presiding, with Jack Sikes, Tom Shellington, Kurt Bulgrin and Paul Buller.  Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times, Kelly, Turner County Clerk and Amanda Ring, York County Deputy Clerk. The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

Shannon Graves spoke with the Board of Commissioners to talk about the Zoning Comprehensive Plan and give her a time line for completion.  The Planning Committee has a public hearing and if there are no changes, than it comes before the Board of Commissioners and they adopt the Zoning Plan, there is no estimated time period.  In the York News Times Paper in November 2010, there was an article about the County to consider pipeline Zoning Regulations, but nothing happened since then.  Mr. Bulgrin stated that they were waiting to see what the Presidential level was doing.

 

Harvey Keim and Tom Mommens met with the Board of Commissioners with update on the Roads Department, all the storm damage has been cleaned up and now starting to begin work on the 1 & 6 year projects.   The Road Department is also working on keeping the culverts clean from debris. 

 

Susan Donavan spoke with Board of Commissioners about keeping her culvert clean; she has hired an excavator to clean her driveway so she can have access in and out of her property.  The road department explained that the debris is coming from down stream along with corn stalks and erosion and it gets stuck in the culvert.

WHEREAS, operating expenses have unexpectedly exceeded revenue; and

 

WHEREAS, the York County Board of Commissioners has been advised by the County Clerk that a deficit appropriation in the sum of $9,910.88 will be required to complete the obligations of this fund for the fiscal year ending June 30, 2014.

 

NOW, THEREFORE, BE IT RESOLVED, that the York County Board of Commissioners hereby finds and declares that an emergency exists in the Area on Aging Fund budget and hereby appropriates from the Inheritance Tax Fund the sum of $9,910.88 for the Area on Aging Fund for the remainder of the fiscal year ending June 30, 2014 for payment of claims.  Such funds are to be reimbursed to the Inheritance Tax Fund when monies become available.

WHEREAS, an emergency exists requiring that said budget be re-opened to provide for an expansion of said budget as provided by law, and

 

WHEREAS, said additional funds to be applied to said budget must be appropriated from a line item currently existing in the General Fund Budget of York County, Nebraska;

 

NOW, THEREFORE BE IT RESOLVED: that the budget of the York County District Court is increased in the amount of $13,910.84 for the 2013-2014 fiscal years resulting in an amended budget of $216,461.84.

WHEREAS, said additional funds to be applied to said budget must be appropriated from a line item currently existing in the General Fund Budget of York County, Nebraska;

 

NOW, THEREFORE BE IT RESOLVED: that the budget of the York County Maintenance is increased in the amount of $8,082.33 for the 2013-2014 fiscal years resulting in an amended budget of $255,441.33.

WHEREAS, an emergency exists requiring that said budget be re-opened to provide for an expansion of said budget as provided by law, and

 

WHEREAS, said additional funds to be applied to said budget must be appropriated from a line item currently existing in the General Fund Budget of York County, Nebraska;

 

NOW, THEREFORE BE IT RESOLVED: that the budget of the York County Surveyor is increased in the amount of $284.25 for the 2013-2014 fiscal years resulting in an amended budget of $10,284.25.

 

AND FURTHERMORE, BE IT RESOLVED: that the sum of $284.25 which has been added to the budget of the York County Surveyor for the 2013-2014 fiscal years shall be appropriated from the Miscellaneous General –County General Fund.

RESOLUTION #14-54

 

            WHEREAS, the York County Board of Commissioners met at their regular meeting on the 24th day of June 2014, and discussed the fact that in fiscal year 2013-2014 to transferred from the Drug Law Enforcement Fund to the General Fund,

 

            WHEREAS, at this time there are funds available for $183.04 from the Drug Law Enforcement Fund to the General Fund.

 

            NOW THEREFORE BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $183.04 from the Drug Law Enforcement Fund to the General Fund.

RESOLTUION #14-55

 

WHEREAS, the County of York approved the creation of a new Fund and be receiving monies for the Drug Law Enforcement Fund (2411); and

 

WHEREAS, the County sees a need for these types of revenues and expenses to be accounted for separately,

 

NOW, THEREFORE, BE IT RESOLVED that a new fund be created for the purpose of recording receipts and expenditures (Federal Drug Money).  Said fund to be called the Drug Law Enforcement Fund (#2411).  Money available in such fund shall be used for the purposes allowed by state statute.

RESOLUTION #14-56        

 

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 24th day of June 2014, and discussed the fact that in the proposed budget for 2013-2014, the Area on Aging Fund would be partially funded by way of interfund transfers from the Inheritance Tax ; and

 

WHEREAS, at this time it is necessary to transfer proposed budgeted funds in order to meet obligations in the amount of $26,000.00  

 

WHEREAS, as the Board of Commissioners are AMENDING Resolution #14-19 to transfer from the Inheritance Tax Fund NOT the General Fund to the Area on Aging Fund,

 

NOW THEREFORE BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $26,000.00 budgeted dollars from the Inheritance Tax Fund to the Area on Aging Fund for the budget year of 2013-2014.

WHEREAS, the Board has been advised that the term of Gerald Hubbard on the York County Veterans Service Committee has expired.

 

WHEREAS, the Board has been advised that Gerald Hubbard is willing to be reappointed to another Five (5) year term; and

 

NOW, THEREFORE BE IT RESOLVED, that Gerald Hubbard is hereby reappointed to serve on the York County Veterans Service Committee for the term of June 30, 2014 through, June 29, 2019.

Drawdown #42 for the Bond Fund was discussed.

Moved by Bulgrin, seconded by Shellington, to approve Bond Drawdown #42, to Diamond Engineering for $29,868.11, and Speece Lewis Engineering for $1,408.12  a total amount of $31,276.23; roll call: yeas, Bulgrin, Shellington, Sikes, Buller and Bamesberger; nays, none; motion carried.

 

Moved by Buller, seconded by Sikes, to approve the Emergency Protective Custody Services Contract with Region V Systems, roll call: yeas, Buller, Sikes, Shellington, Bulgrin and Bamesberger, nays none, motion carried.

 

Carol Knieriem, CASA Director along with Brent Magner and Stan Jensen gave the annual report for the Court Appointed Special Advocates.  They also asked for funding for 2014-2015 in the amount of $31,286.  The Board will take the request into consideration when drafting the budget

 

 

Met with Candace Dick, York County Attorney to discuss Child Support Sub-Grant and Child Advocacy Support of $2,200.  Commissioners request that these items go on the July 8, 2014 agenda.
