The York County Board of Commissioners met according to law on Tuesday, August 19, 2014 at 8:30 a.m. as per notice in the York News Times on August 14, 2014, with Chairman Bill Bamesberger presiding, with Jack Sikes, Kurt Bulgrin, Tom Shellington and Paul Buller.   Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times and Kelly Turner, County Clerk. The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

RESOLUTION #14-69        

 

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 19th day of August 2014, and discussed the fact that in the proposed budget for 2014-2015, the Noxious Weed Fund would be partially funded by way of interfund transfers from the General Fund; and

 

WHEREAS, at this time it is necessary to transfer proposed budgeted funds in order to meet obligations in the amount of $10,000.00.  

 

NOW THEREFORE BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $10,000.00 budgeted dollars from the General Fund to the Noxious Weed Fund for the budget year of 2014-2015.

RESOLUTION #14-70

 

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 19th day of August 2014, to discuss and act on an emergency created in the funds available in the Juvenile Diversion Fund; and

 

WHEREAS, operating expenses have unexpectedly exceeded revenue; and

 

WHEREAS, the York County Board of Commissioners has been advised by the County Clerk that a deficit appropriation in the sum of $1,000.00; and

 

NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $1,000.00 from the Inheritance Tax Fund to the Juvenile Diversion Fund.  Such funds are to be reimbursed to the Inheritance Tax Fund when monies become available.

On or before August 1st, all political subdivisions subject to county levy authority under levy limits must submit a preliminary request for levy allocation.  Based on those requests, the Board then must allocate a preliminary levy for those subdivisions.

WHEREAS, Nebraska State Statute 77-3443 (3) requires all political subdivisions subject to county levy authority to submit a preliminary request for levy allocation; and

 

WHEREAS, the political subdivisions that are subject to York County Levy authority are agricultural society, historical society, rural fire districts and cemetery districts; and

 

WHEREAS, the York County Board of Commissioners has determined that due to the number of political subdivisions and taxing parcels that would be affected, that a maximum levy will be established and if the subdivisions request is over that maximum levy, their levy will be set at that maximum levy;

Sandy Morrissey, Director of the Region V Systems provided the Board with an update of their services.

 

Benjamin Dennis and Orval Stahr met with the Board and presented 3 Resolutions that were passed, by the York County Planning Commission, Resolution #14-1 Comprehensive Plan, Resolution #14-2 Subdivision Regulations and Resolution #14-3 Zoning Regulations.  Orval suggested on holding the public hearing in the evening so more of the public may attend.

 

Moved by Bulgrin, seconded by Sikes to hold the Public Hearing on September 16, 2014 at 7:00 P.M. to review Comprehensive plan, Zoning Regulations and Subdivision Regulations roll call; yeas, Bulgrin, Sikes, Shellington, Buller and Bamesberger, nays none, motion carried.

A Budget Workshop with the Elected Officials was held at 1:00 p.m., Bulgrin made a motion to up the YCDC from $50,000.00 to $70,000.00, seconded by Shellington, roll call; yeas Bulgrin, Shellington, Sikes, Buller, and Bamesberger, nays none, motion carried.  The Budget Hearing to adopt the 2014-2015 Budget will be held on September 2, 2014 at 10:15 a.m.
