The York County Board of Commissioners met according to law on Tuesday, November 25, 2014 at 8:30 a.m. as per notice in the York News Times on November 20, 2014, with Chairman Bill Bamesberger presiding, with Jack Sikes and Tom Shellington.  Kurt Bulgrin and Paul Buller were absent.   Also present at the meeting was Melanie Wilkinson with the York News Times and Kelly Turner, County Clerk. The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

Harvey Keim York County Highway Superintendant introduced Bill Boyer sales manager for Murphy Tractor and Equipment Co.  Updated the Commissioners on the Motor Grader that was rebuilt, and gave updates of the Road Department.

 

Moved by Sikes, motion failed for lack of no seconded motion, on granting permission to EA Engineering, Science and Technology Inc, to Drill 11 Monitoring Wells in County Road Right of Way, will revisit this on December 23rd agenda.

 

INTERFUND TRANSFERS:

Moved by Bamesberger, seconded by Shellington, to adopt Resolution #14-88 to transfer $5,000.00 from Inheritance Tax Fund to State Institutions Fund, roll call; yeas, Bamesberger, Shellington and Sikes, nays none, Buller & Bulgrin absent, motion carried.

RESOLUTION #14-88

 

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 25th day of November 2014, to discuss and act on an emergency created in the funds available in the State Institutions Fund; and

 

WHEREAS, operating expenses have unexpectedly exceeded revenue; and

 

WHEREAS, the York County Board of Commissioners has been advised by the County Clerk that a deficit appropriation in the sum of $5,000.00; and

 

NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $5,000.00 from the Inheritance Tax Fund to the State Institutions Fund.

Annually, the Board must designate a county newspaper for publication purposes.

Requests were received from local financial institutions to be approved as depositories for county funds.

RESOLUTION #14-89

 

 

BE IT RESOLVED by the Board of Commissioners of York County, Nebraska, that during the year 2015, and for the remainder of the term of Brenda Scavo as York County Treasurer, or until further directed by this Board that the following named institutions, upon their several requests duly filed and made a part of the Resolution shall be depositories for the funds of York County, Nebraska, to wit:

 

Cornerstone Bank, York, Nebraska

Henderson State Bank, Henderson/York, Nebraska

Midwest Bank, York, Nebraska

Union Bank, York, Nebraska

York State Bank, York, Nebraska

 

PROVIDED that the aforesaid banks, each and all of them shall meet with all requirements imposed by the laws of the State of Nebraska, regarding proper bonds and securities for any deposits made in said bank.

 

BE IT FURTHER RESOLVED, that the County Treasurer of York County, Nebraska, is hereby directed and authorized to deposit the funds of York County, Nebraska, during the year, 2015, and for the remainder of the term of the said Brenda Scavo, as County Treasurer, or until further directed by this Board, in the depositories above named in this Resolution.

 

BE IT FURTHER RESOLVED, that Brenda Scavo, County Treasurer, may when the amount of money which she desires to deposit in the various depositories within the County exceeds fifty percent of the combined stock and surplus on any one individual depository; PROVIDED said depositories for such excess deposits shall furnish additional bond of securities as the case may be, and shall comply in all respects with the requirements imposed by the laws of the State of Nebraska.

RESOLUTION #14-90

 

WHEREAS, the York County Board of Commissioners at its regular meeting on November 25, 2014, discussed the fact that on September 2, 2014, the proposed budget statement for the County Road fund was adopted, such total budget being in the sum of $4,400,086.19.  There are funds to be transferred from the County General Fund to the County Road Fund in the approximate amount of $1,917,635.16; and

 

WHEREAS, the amount of revenue in the General Fund to be generated from Property Taxes is set at $4,441,470.99;

 

NOW BE IT RESOLVED, that the York County Treasurer shall transfer 43.176% of the 2014-2015 taxes collected for the County General Fund be transferred to the County Road Fund as per the adopted budget.

 Shelly and Allen Clark were present at the hearing and no comment was given by those present.  The hearing was closed at 9:08 a.m.

Chad Engle from NIRMA met with the Commissioners and Elected Officials to go over Loss Prevention and Best Safety Practices for the County.

The Chairman declared the meeting adjourned at 10:35a.m.  The next meetings will be held, December 9, 2014 at 8:30 a.m.  In the County Commissioners Room, lower level of the Courthouse for the regular meeting.
