The York County Board of Commissioners met according to law on Tuesday, December 23, 2014 at 8:30 a.m. as per notice in the York News Times on December 18, 2014, with Chairman Bill Bamesberger presiding, with Jack Sikes, Paul Buller, Kurt Bulgrin and Tom Shellington. Also present at the meeting was Melanie Wilkinson with the York News Times, Kelly Turner, County Clerk and Randy Obermier incoming County Commissioner. The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.
Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room. Proof of publication was also available.

Benjamin Dennis met with the Board there is no Zoning issue when working in the Right of Way, just need permission from the Board when discussing drilling wells.

Moved by Sikes, seconded by Bulgrin to conditionally grant permission to the EA Engineering, Science and Technology Inc. to drill 11 monitoring wells in the County ROW in the area of the Atlas Missal Site 10, with the condition being approval of necessary liability and indemnity agreement between EA Engineering and the County; roll call, yeas, Sikes, Bulgrin, Buller, Shellington and Bamesberger, nays none, motion carried.

Moved by Bulgrin, seconded by Buller to accept the bids from Conner Roofing Co., Inc. in the amount of $99,745.00 to fix the storm damage to the Road Department and accept the bid from Naber’s in the amount of $2,345.00 to fix the storm damage to the Courthouse, Extension and Historical Building that accrued in June, 2014; roll call, yeas, Bulgrin, Buller, Shellington, Sikes and Bamesberger, nays none, motion carried.
Moved by Shellington, seconded by Bulgrin, to adopt Resolution #14-92 to amend Resolution #14-88 that the State Institution needs to reimburse the Inheritance Tax Fund when such monies become available; roll call, yeas, Shellington, Bulgrin, Sikes, Buller and Bamesberger, nays none, motion carried.
WHEREAS, the York County Board of Commissioners met at their regular meeting on the 23rd day of December 2014, to amend the Resolution #14-88, and
WHEREAS, the Board is amending Resolution #14-88 to read, Such funds are to be reimbursed to the Inheritance Tax Fund when Monies become available, and
NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $5,000.00 from the Inheritance Tax Fund to the State Institutions Fund. Such funds are to be reimbursed to the Inheritance Tax Fund when Monies become available.

Moved by Bulgrin, seconded by Sikes, to adopt Resolution #14-93 appointing Barb Woodruff and Jason Perdue to the Extension Board for a three (3) year term 1-1-2015 thru 12-31-2017 , roll call, yeas, Bulgrin, Sikes, Shellington, Buller, and Bamesberger, nays none, motion carried.
WHEREAS, the Extension Board has requested the reappointing and appointing of board members; and
WHEREAS, current board member, Barbara Woodruff has agreed to be reappointed for a three (3) year term; and
WHEREAS, Jason Perdue will be replacing John Mittman, and
WHEREAS, Jason Perdue has agreed to be appointed for a three (3) year term; and
NOW, THEREFORE BE IT RESOLVED that as of January 1, 2015, Barbara Woodruff and Jason Perdue hereby be appointed their term which will expire December 31, 2017.

At 9:30 a.m. as advertise on December 9 and December 16, 2014, in the York News Times, with proof of publication attached, Chairman Bamesberger declared a public hearing be held to hear support, opposition, suggestions, criticism or observation for appointment of members of the Board of Trustees of Hospital Authority No. 1. Name as follows: Chuck Harris, Sally Ruben, Alan Janzen and Jim Green.
No one was present from the public to speak to the matter; therefore, the public hearing was closed at 9:31a.m.
Moved by Bamesberger, seconded by Sikes to adopt Resolution #14-94 appointing Chuck Harris and Alan Janzen for a period of January 20, 2015 to January 31, 2021 and Sally Ruben and Jim Green for the period of January 31, 2015 to January 31, 2021 as Trustees of the York County Hospital Authority No. 1; roll call: yeas, Bamesberger, Sikes, Shellington, Buller and Bulgrin; nays, none; motion carried.
whereas, on November 26, 2014, a petition was filed with the York County Clerk seeking the appointment of members to the Board of Trustees of hospital authority number one of York County; and
WHEREAS, the Board of County Commissioners have been given the authority to appoint trustees to the hospital authority under the provisions of the Nebraska Hospital Authorities Act §23-3591 Reissue Revised Statutes of Nebraska, 1943, as amended; and
WHEREAS, the Board has ascertained, to its satisfaction, that the petition is valid and duly executed, that the required notice of the hearing on the request contained in the petition has been published as required by law, and that each of the proposed members of the Board of Trustees have met the qualifications set forth under the provisions of the Hospital Authority Act and should be appointed to serve the respective terms set forth in said petition until their successors are appointed and have qualified;
NOW, THEREFORE, BE IT RESOLVED that the following individuals be appointed to serve as Trustees of Hospital Authority No. 1 of York County, Nebraska for their respective term until their successors are appointed and have qualified:
