The York County Board of Commissioners met according to law on Tuesday, June 9, 2015 at 8:30 a.m. as per notice in the York News Times on June 5, 2015, with Chairman Bill Bamesberger presiding, with Kurt Bulgrin, Randy Obermier, Paul Buller and Jack Sikes.   Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times and Kelly Turner, County Clerk.

 

The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

 

Moved by Sikes, seconded by Obermier to approve the minutes of the May 26, 2015, roll call; yeas, Sikes, Obermier, Buller, Bulgrin and Bamesberger, nays none, motion carried.

 

Moved by Bulgrin, seconded by Sikes to adopt the agenda for Tuesday, June 9, 2015, with the changes of moving Discuss and Act on Juvenile and Adult Diversion to 10:45 Remove Discuss and Act on Card Reader for Jail and the 11:00 and 11:15 agenda items should be moved under the Board of Commissioners, roll call; yeas, Bulgrin, Sikes, Obermier, Buller and Bamesberger; nays, none; motion carried.

 

Harvey Keim met with the Board with update on the Road Department.

 

Gary Peterson met with the Board with update on the flooding in McCool Junction area and NEMA.

 

Moved by Bulgrin, seconded by Sikes to adopt Resolution #15-31to approve reappointing Willard Peterson Ardis Burkholder and Marsha Ward to the Aging Service Commission  Board for a two (2) year term beginning July1, 2015 through June 30, 2017, roll call: yeas, Bulgrin, Sikes, Obermier, Buller and Bamesberger; nays none; motion carried.

RESOLUTION #15-31

 

 

WHEREAS, the Aging Service Commission Board has requested the reappointment of members to its Board; and

 

WHEREAS, current board members, Willard Peterson, Marsha Ward and Ardis Burkholder has agreed to be reappointed for another 2 years; and

 

NOW, THEREFORE BE IT RESOLVED, that as of July 1, 2015, Willard Peterson, Marsha Ward and Ardis Burkholder hereby reappointment to another two (2) year term which will expires June 30, 2017.

Moved by Obermier, seconded by Buller to approve the Chairman of the Board to sign the Service Contract Aging Partners-Care Management Unit, This agreement dated July 1, 2015, by and between the City of Lincoln, doing business as, Aging Partners hereinafter referred to as ‘CMU” and the County of York, Nebraska, hereinafter referred to as Care Management services to residents or York County, Nebraska.  The CMU desires to hire the Contractor to provide assessment, screening and care management services to its citizens, and to offset certain costs associated with the delivery of services of York County residents, roll call: yeas, Obermier, Buller, Bulgrin, Sikes and Bamesberger, nays none, motion carried.

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 9th day of June 2015, to discuss and act on an emergency created in the funds available in the Debt Service Fund; and

 

WHEREAS, operating expenses have unexpectedly exceeded revenue; and

 

WHEREAS, the York County Board of Commissioners has been advised by the County Clerk that a deficit appropriation in the sum of $63,787.94; and

 

NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $63,787.94 from the Inheritance Tax Fund to the Debt Service Fund, and when funds in the amount of $13,787.94 come available need to be transfer back to the Inheritance Fund

WHEREAS, the York County Board of Commissioners has been advised by the County Clerk that a deficit appropriation in the sum of $1,913.71; and

 

NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $1,913.71 from the General Fund to the Juvenile Diversion Fund, and when Grant monies in the amount of $1,913.71 come available need to be transfer back to the General Fund.

Richard Nations gave the annual report for the Blue Valley Community Action Partnership.  They also asked for funding for 2015-2016 in the amount of $9,540.00.  The Board will take the request into consideration when drafting the budget.

 

Lisa Hurley gave the annual report for the York County Development Corporation.  They also asked for funding for 2015-2016 in the amount of $70,000.00.  The Board will take the request into consideration when drafting the budget.

 

Carmen Hinman gave the annual report for the Hope Crisis.  They also asked for funding for 2015-2016 in the amount of $6,000.00.  The Board will take the request into consideration when drafting the budget.

Met with Candace Dick York County Attorney to discuss Juvenile and Adult Diversion Funds.  Candace is working with Dr. Lucas Superintendent for York Schools on an Interlocal agreement to have York School take over the Juvenile Diversion Program and Ms. Dick will over see the budget.  Also Ms. Dick suggested eliminating the Adult Diversion Fund.

 

Tabled the York County Handbook changes to Tuesday June 23 meeting at 1:30 p.m. to allow more time to go over each item.

 

Moved by Obermier, seconded by Sikes, to adopt Resolution #15-34 by directing  the County Highway Superintendent to direct a study of the use of railroad crossing described as:  “All of County Road L from a point 50 feet north of the north right-of-way line of the BNSF Railway to a point 100 feet south of the south right-of-way line of the BNSF Railway,  lying on the Section Line between Section 35 and Section 36, Township 11 North, Range 3 West, York County, Nebraska”, and submit a report in writing, with his recommendation as to the vacation or abandonment thereof, roll call; yeas, Obermier, Sikes and Bamesberger, nays, Buller and Bulgrin, motion carried.

                                                Resolution #15-34

 

WHERAS,  pursuant to the approval by voters of the City of York, Nebraska to approve an additional one-half of one percent (1/2%) sales and use tax at the general election on November 4, 2014 for the purpose of the construction of infrastructure projects to include a quiet zone for railroad crossings; and

 

WHEREAS, the York Community infrastructure and Recreation Committee created to implement the public infrastructure projects authorized by the sales tax ordinance, has recommended that railroad crossing located on County Road L (CR L, BNSF Milepost 57.15 US DOT # 083427F)  outside the City limits but within the City’s zoning jurisdiction be closed so that such crossing may be converted into a quiet zone; and

 

WHEREAS, the Mayor of York and City Council have approved the closing of the following portion of County Road L and BNSF Railway Crossing (CR L, Milepost 57.15, US DOT # 083427F) located within the County of York and the zoning jurisdiction of the City of York, as provided by Neb. Rev. Stat. 39-1722 (Reissue 2008).  The portion of the road requested to be vacated or abandoned is described as follows:

 

            All of County Road L from a point 50 feet north of the north right-of-way line of the BNSF                                     Railway to a point 100 feet south of the south right-of-way line of the BNSF Railway, lying on the             Section Line between Section 35 and Section 36, Township 11 North, Range 3 West, York County,                         Nebraska.

 

WHEREAS, pursuant to the foregoing, the County Board of York County, Nebraska deems the public interest may require vacation or abandonment of the aforementioned railroad crossing.

 

NOW THEREFORE, BE IT HEREBY RESOLVED, that pursuant to Neb. Rev. Stat. 39-1722, the County Board of York County, Nebraska directs the York County Highway Superintendent to study the use being made of that portion of County Road L and BNSF Railway Crossing (CR L, Milepost 57.15, US DOT # 083427F) located within the County of York, Nebraska.  The portion of the road to be studied is described as follows:

 

            All of County Road L from a point 50 feet north of the north right-of-way line of the BNSF                                     Railway to a point 100 feet south of the south right-of-way line of the BNSF Railway, lying on the             Section Line between Section 35 and Section 36, Township 11 North, Range 3 West, York County,                         Nebraska.

 

Said study shall be made within thirty days and shall include the Highway Superintendent’s recommendation as to the vacation of abandonment of the portion of the road described above.  The Superintendent’s recommendation shall be retained in the office of the county clerk as part of the permanent public records of the County Board.
