The York County Board of Commissioners met according to law on Tuesday, August 18, 2015 at 8:30 a.m. as per notice in the York News Times on August 13, 2015, with Chairman Bill Bamesberger presiding, with Jack Sikes, Randy Obermier, Kurt Bulgrin and Paul Buller.  Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times, Kelly, Turner County Clerk.

 

  The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.

 

Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room.  Proof of publication was also available.

A Resolution by the County of York, Nebraska, providing for full participation by the County in the Southeast Nebraska Development District organized under the interlocal Cooperation Act, Sections 13-801 through 13-87, Nebraska Reissued Statutes (Reissue 1997 and Supp. 2002), of the State of Nebraska and under authority of Sections 13-1901 to 13-1907, Nebraska revised Statutes (Reissue 1997) (the Nebraska Development District Act).

 

Be it resolved by the County Board of Commissioners that the County of York, Nebraska hereby declared its intent to join with the incorporated villages, cities or counties that are eligible and may wish to participate as a member of the Southeast Nebraska Development District through execution of an intergovernmental agreement.

 

Be it further resolved that the Chairman of the County Board of Commissioners of York County is hereby authorized, on behalf of the County, to execute said agreement allowing for participation by York County in the Southeast Nebraska Development District, which said agreement shall be substantially in the words and figures set forth in that certain agreement, a copy of which is attached hereto and made a part hereof.

At 10:00 a.m. as advertise on July 28 and August 4 and 11, 2015, in the York News Times, Chairman Bamesberger declared a public hearing be held to hear support, opposition, suggestions, criticism or observation to discuss Railroad Crossing Possible Closing.  All of County Road L from a point 50 feet north of the north right-of –way line of the BNSF Railway to a point 100 feet south of the south right-of-way line of the BNSF Railway, lying on the Section Line between Section 35 and Section 36, Township 11, North Range 3 West, York County Nebraska.

WHEREAS, pursuant to Nebraska Revised Statute 39-1724 and 39-1725, on August 18, 2015 at 10:00 a.m. the County Board held a public hearing regarding the vacation or abandonment of the following potion of County Road L.

 

All of County Road L from a point 50 feet north of the north right-of-way line of the BNSF Railway to a point 100 feet south of the south right-of-way line of the BNSF Railway, lying on the Section Line between Section 35 and Section 36, Township 11 North, Range 3 West, York County, Nebraska.

 

WHEREAS, Board Member Randy Obermier introduced the following Resolution:

 

To vacate “all of County Road L from a point 50 feet north of the north right-of-way line of the BNSF Railway to a point 100 feet south of the south right-of-way line of the BNSF Railway, lying on the Section Line  between Section 35 and Section36, Township 11 North, Range 3 West, York County, Nebraska, contingent upon modifications been done to a bridge which would allow Daniel Grotz to drive large farm equipment using an alternative route;  and that the vacated fragment or section of road shall remain in the public.”

 

NOW, THEREFORE, BE IT HEREBY RESOLVED, that the County Board voted to refuse the vacation or abandonment of the following portion of County Road L

RESOLUTION #15-55

 

WHERAS, the Federal Disaster Mitigation Act of 2000 was signed into law on October 30, 2000, placing new emphasis on state and local mitigation planning for natural hazards and requiring communities to adopt a hazard mitigation action plan to be eligible for pre-disaster and post-disaster federal funding for mitigation purposes: and                   

   

WHERAS, a Multi-jurisdictional Hazard Mitigation Plan was prepared by York County, Nebraska with assistance from JEO Consulting Group, Inc. of Lincoln, NE. which includes the jurisdiction of York County.

 

WHERAS, the purpose of the mitigation plan was to lessen the affects of disasters by increasing the disaster resistance of the County and participating jurisdictions located within the planning boundary by identifying the hazards that affect the County and prioritize mitigation strategies to reduce potential loss of life and property damage from those hazards, and

 

WHERAS, FEMA regulation require documentation that the plan has been formally adopted by the governing body of York County in the form of a resolution and further requesting approval of the plan at the Federal Level; and

 

NOW, THEREFORE, the governing body of York County, does herewith adopt the York County Multi-jurisdictional Hazard Mitigation Plan in its entirety; and

RESOLUTION #15-56

 

 

                                    WHEREAS, the County of York approved the creation of a new fund and be receiving monies from the Inheritance Tax Fund (2700), and

 

                                    WHEREAS, the County sees a need for these types of revenues and expenses to be accounted for separately, and

 

                                    NOW THEREFORE BE IT RESOLVED, that a new fund be created for the purpose of recording receipts and expenditures.  Said fund to be called the Law Enforcement Center/911 Communications (#2940).  Money available in such fund shall be used for the purposes of the 911 Communication Center.

                                     

            NOW THEREFORE BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $1,000,000.00 (one million), from the Inheritance Tax Fund to the Law Enforcement Center/911 Communications.
