The York County Board of Commissioners met according to law on Tuesday, October 11, 2016 at 8:30 a.m. as per notice in the York News Times on October 6, 2016, with Chairman Bill Bamesberger presiding, with Kurt Bulgrin, Randy Obermier, Paul Buller and Jack Sikes. Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times and Kelly Turner, York County Clerk.
The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.
Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room. Proof of publication was also available.

INTERLOCAL COOPERATION AGREEMENT
YORK COUNTY AND THE VILLAGE OF GRESHAM
REGARDING SNOW REMOVAL ON CHERRY STREET
WHEREAS, both of the parties hereto are political subdivisions of the State of Nebraska, and
WHEREAS, the Interlocal Cooperative Act, Neb. Rev. Stat. 13-801 to 13-827, permits local governmental units to make the most efficient use of their powers to enable them to cooperate with other governmental units in an effort to provide services and facilities in a manner that will benefit the needs of their local communities, and
WHEREAS, No agreement made pursuant to the Interlocal Cooperation Act shall relieve any public agency of any obligation or responsibility imposed upon it by law. (Neb. Rev. Stat. Ann. § 13-804)
WHEREAS, SNOW REMOVAL on that portion of Cherry Street which runs east from Highway 69, until it becomes Gresham Road at the corporate limits of the Village of Gresham (2,182 feet), will be more efficiently, adequately, and economically maintained by assigning snow removal duties to York County, at reasonable cost to the Village of Gresham.
WHEREAS, York County agrees to perform snow plowing and snow blowing services for the above-defined portions of Cherry Street as needed each year, but only at the request of the Village of Gresham.
WHEREAS, The Village of Gresham agrees to reimburse the County for the price of said services based on the following rates:
1. Labor: $24.15 per hour for the motor grader operator;
2. J.D. Grader: $65.91 per hour for the motor grader;
3. Loader: $80.87 per hour;
4. Snow blower: $402.84 per hour;
WHEREAS, York County will maintain responsibility for providing its workers with worker’s compensation coverage and for any claims associated with its employees. York County will also maintain responsibility for paying wages to its employees, including benefits.
WHEREAS, The Village of Gresham agrees to reimburse the County within 30 days of receiving an invoice from the County for work performed pursuant to this Agreement.
WHEREAS, this Agreement may be modified, only in writing, and with the approval of both governing bodies of the parties. This Agreement may also be terminated at any time by either governing body, in writing, and giving notice to the other party.
NOW THEREFORE BE IT RESOLVED, that York County and the Village of Gresham will be responsible for snow removal on Cherry Street as so stipulated above. Both parties agree to comply with the terms and conditions set forth herein and to maintain said roads in accordance with the standards of the industry.
Mitch Doht met with the Board on Road Crossing permit for pipeline going out to the new waste water treatment plant.
