The York County Board of Commissioners met according to law on Tuesday, October 25, 2016 at 8:30 a.m. as per notice in the York News Times on October 20, 2016, with Chairman Bill Bamesberger presiding, with Kurt Bulgrin, Randy Obermier, Paul Buller and Jack Sikes. Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times and Kelly Turner, York County Clerk.
The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.
Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room. Proof of publication was also available.

A Public Hearing was held at 9:00 a.m. as published in the York News Times on October 12, 2016 to hear support, criticism, suggestions or observations relating to rezoning permit applied for by Lola Gibbs-Edelman to change the zoning for PT of IRR TR #6, a 4.10 acre parcel in the W1/2 of theNW1/4 20-10-4W from Interstate Commercial/Industrial to Rural Commercial/Industrial.
Proof of publication was available. Present at the hearing were Commissioners Bamesberger, Buller, Bulgrin, Obermier, and Sikes; Melanie Wilkinson for the News Times, Clerk Kelly Turner, and Benjamin Dennis, Zoning Administrator, Orval Stahr, Lola J Gibbs Edelman, Bill Edelman and Patty Christopher.
Lola J Gibbs Edelman and Bill Edelman are for the zoning change and Patty Christopher is against the zoning change. The hearing was closed at 9:24 a.m.

Proof of publication was available. Present at the hearing were Commissioners Bamesberger, Buller, Bulgrin, Obermier, and Sikes; Melanie Wilkinson for the News Times, Clerk Kelly Turner, and Benjamin Dennis, Zoning Administrator and Orval Stahr.
The hearing was closed at 9:32 a.m.
Moved by Bulgrin, seconded by Obermier, to accept the recommendation of the Zoning Board, to approve the proposed conservation easement zoning regulations, roll call: yeas; Bulgrin, Obermier, Sikes, Buller and Bamesberger, nays none, motion carried.

Moved by Bamesberger, seconded by Obermier that York County grant permission to the City of York to install and maintain the Wellhead Protection signs in the outside 2 feet of the Right of Way of York County Roads, roll call, yeas; Bamesberger, Obermier, Sikes, and Bulgrin, nays none, Buller absent, motion carried.
Moved by Bulgrin, seconded by Obermier, that York County authorizes the installation of a historical marker measuring 42 inches by 30 inches to be installed within the boundaries of the cemetery, so long as the county will bear no expense for the price of the sign, it’s placement, installation, or maintenance, roll call, yeas; Bulgrin, Obermier, Sikes and Bamesberger, nays none, Buller absent, motion carried.
Moved by Obermier, seconded by Bulgrin, to approve proposed project and cost sharing allocation between NDOR, BNSF, and the County for cantilever active warning devices at Railroad crossings at Road J and Road N in York County, roll call, yeas; Obermier, Bulgrin, Sikes and Bamesberger, nays none, Buller absent, motion carried.
