The York County Board of Commissioners met according to law on Tuesday, November 22, 2016 at 8:30 a.m. as per notice in the York News Times on November 17, 2016, with Chairman Bill Bamesberger presiding, with Kurt Bulgrin, Randy Obermier, Paul Buller and Jack Sikes. Also present at the meeting was Melanie Wilkinson, correspondent for the York News Times, Benjamin Dennis, Deputy County Attorney, Dena Bushnell, General Assistance Director, Luke Fochtman, correspondent for KAWL and Kelly Turner, York County Clerk.
The agenda of the meeting was posted on the bulletin board in the County Clerk’s office and a copy of the agenda was made available to each Commissioner.
Bamesberger announced that the Open Meetings Act was posted outside the door along with copies in the back of the Board Room. Proof of publication was also available.

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 22nd day of November 2016, to discuss and act on an emergency created in the funds available in the Juvenile Diversion Fund; and
WHEREAS, operating expenses have unexpectedly exceeded revenue; and
WHEREAS, the York County Board of Commissioners has been advised by the County Clerk that a deficit appropriation in the sum of $1,000.00; and
NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of $1,000.00 from the General Fund to the Juvenile Diversion Fund, and when Grant monies in the amount of $1,000.00 come available need to be transfer back to the General Fund

Moved by Bulgrin, seconded by Obermier, to adopt Resolution #16-51 setting the percentage of funds to be transferred from the General Fund to the Road Fund for fiscal year 2017-2018 at 34%, roll call: yeas, Bulgrin, Obermier, Sikes, Buller and Bamesberger, nays none, motion carried.
WHEREAS, the York County Board of Commissioners at its regular meeting on November 22, 2016, discussed the fact that on August 30, 2016, the proposed budget statement for the County Road fund was adopted, such total budget being in the sum of $4,769,054.53. There are funds to be transferred from the County General Fund to the County Road Fund in the approximate amount of $1,909,924.07; and
WHEREAS, the amount of revenue in the General Fund to be generated from Property Taxes is set at $5,616,751.67;
NOW BE IT RESOLVED, that the York County Treasurer shall transfer 34% of the 2017-2018 taxes collected for the County General Fund be transferred to the County Road Fund as per the adopted budget.

Moved by Obermier, seconded by Sikes, to adopt Resolution #16-52 setting salaries for the county officials which reflect a 3% increase for the 2017 salary (Clerk, Assessor, Clerk of the District Court, Public Defender and Treasurer) at $ 56,759.08, Sheriff at $67,842.36 and County Attorney at $76,701.94; roll call: yeas, Obermier, Sikes, and Bamesberger, nays Buller and Bulgrin, motion carried.
WHEREAS, the York County Board of Commissioners met on November 22, 2016 at their regular meeting to discuss and act on the salaries for the Elected Officials of York County. Notice of the hearing to consider and set salaries was given by publishing such notice in the agenda.
WHEREAS, the salaries to be set are Elected Officials of York County being as follows: York County Assessor, York County Clerk, York County Clerk of the District Court, York County Treasurer, York County Sheriff, York County Public Defender and York County Attorney.
NOW THEREFORE, BE IT RESOLVED, that the Elected Officials of York County shall receive the following salaries for the year 2017, and shall receive an increase each of the following years for the years 2017 and 2018 as described below. Said increases shall take effect January 1 of each subsequent year.
(FOR THE YEAR 2017)
York County Clerk, County Assessor, County Treasurer and County Clerk of the District Court, York County Public Defender; $56,759.08
York County Sheriff: $67,842.36
York County Attorney: $76,701.94
(FOR THE YEARS 2017 AND 2018 – Annual Cost of Living Adjustment)
Annual adjustments for 2017 and 2018 will be based on the Midwest Consumer Price Index as established by the Bureau of Labor Statistics, U.S. Department of Labor except when the CPI falls below “0” and except when the CPI raises above 3% in any year, in which case the annual adjustment will be no more than 3%.
In addition to and in consideration of the above salaries, the following will also apply:
1. The County Attorney position shall remain a full-time position with no private practice allowed.
2. The Deputy Public Defender position shall remain discontinued.
3. The County on an annual basis during the term of this Resolution reserves the right to contract out or enter into an agreement with an Elected Official or Officials who are qualified to serve as a budget-making authority as may be approved by the Board. It is the intent of the York County Board that if an agreement is made with an Elected Officials, that such agreement shall not constitute an increase in the herein adopted salary but shall be and is a part of the agreement. If the Board contracts with an Elected Official to serve as the budget making authority, that official shall be allowed an additional amount not to exceed $1,500.00 for performing those duties.
4. Be it further resolved that in addition to the above stated salaries, each County Official shall receive benefits as provided in the York County Employee Manual consisting of health insurance, life insurance, disability insurance and retirement benefits.
