The York County Board of Commissioners met May 27, 2003 as per notice in the York News Times on May 23, 2003 with Bob Wolfe presiding with James Klute, Eugene Bergen and Dale Euchner present. Commissioner Kenneth Stuhr was absent.



The agenda of the meeting was posted on the bulletin board in the County Clerk's office and a copy of the agenda was mailed to each Commissioner.

The Board met at the County Shop and with the General Assistance Administrator prior to the regular meeting.



Moved by Euchner, seconded by Klute, that the minutes of the May 13, 2003 meeting be approved as submitted; roll call: yeas, Euchner, Klute, Bergen and Wolfe; nays, none; Stuhr absent; motion carried.



Commissioner Euchner asked that the right to amend the agenda be reserved until later if necessary.



The Board reviewed General Assistance Cases. There was only one General Assistance Case, that being an ongoing case #03-08 for a request of $185.03 for medication.



Moved by Euchner, seconded by Bergen, that the Board approve General Assistance Case #03-08 in the amount of $185.03 for medication; roll call: yeas, Euchner, Bergen, Klute and Wolfe; nays, none; Stuhr absent; motion carried.



The Board tabled action on appointing a Weed Superintendent until their next meeting.



Moved by Bergen, seconded by Klute, that the Board approve payment of voucher #21 to Bradshaw Village, CDGB Account, in the amount of $1,349.14 from the York County Highway Allocation Fund Bonds, Series 2001, Project Fund; roll call: yeas, Bergen, Klute, Euchner and Wolfe; nays, none; Stuhr absent; motion carried.



Moved by Euchner, seconded by Klute, that the following Resolution be adopted.



RESOLUTION NO. 22

WHEREAS, the York County Board of Commissioners met at their regular meeting on the 27th day of May 2003, to discuss and act on an emergency created in the appropriations available in the budget of the Planning & Zoning to operate until the end of the fiscal year which will be completed on June 30, 2002; and



WHEREAS, unanticipated operating expenses have been required as a result of administration; and



WHEREAS, the York County Board of Commissioners has been advised by the York County Clerk that a deficit appropriation in the sum of $3,500.00 will be required to complete the obligations of its office for the fiscal year ending June 30, 2003.



NOW, THEREFORE, BE IT RESOLVED, that the York County Board of Commissioners hereby finds and declares that an emergency exists in the budget of the Planning & Zoning, and hereby appropriates from the Child Support-District Court Clerk Budget in the General Fund of the County the sum of $3,500.00 for the budget of the Planning & Zoning for the remainder of the fiscal year ending June 30th, 2003 for payment of claims.

RESOLUTION NO. 23



WHEREAS, on September 17, 2002, the York County Board of Commissioners adopted a budget for the Juvenile Diversion Program in the amount of $22,458.02, the funds being provided by a grant from the Nebraska Crime Commission and York County, Nebraska.



WHEREAS, the County agreed to pay $2,624.12 of the budgeted amount to support the Juvenile Diversion Program.



NOW, THEREFORE, BE IT RESOLVED, that the York County Treasurer shall transfer the sum of Two Thousand Six Hundred Twenty Four and 12/100 Dollars ($2,624.12) from the General Fund to the Juvenile Diversion Fund for expenditure as the County's share of the Juvenile Diversion Project for the 2002-2003 budget year.

The Board discussed the temporary road closing agreement between Progressive Ag Partners and York County.



Moved by Wolfe, seconded by Euchner, that the Board not sign the agreement on a temporary closing with Progressive Ag Partners based upon the Attorney's opinion and that the County relook at the issue and have another public hearing to permanently close the road or leave Road F open; roll call: yeas, Wolfe and Euchner; nays, Klute and Bergen; Stuhr absent; motion failed.



Informal quotes for furnishing hot bulk meals for the York Senior Meals Program were opened as advertised. Only one quote was received, that being from Bag'n Sav for $3.99 for meal.



Moved by Klute, seconded by Euchner, that the Board accept the informal quote for hot bulk meals for the York Senior Meals Program from Bag'n Sav for $3.99 per meal; roll call: yeas, Klute, Euchner, Bergen and Wolfe; nays, none; Stuhr absent; motion carried.



Dave Merrill, Executive Director of Region V Services; Barbara Graves, Area Director and C. J. Johnson, Representative of Region V Systems, met with the Board to present their annual report and funding request for the next fiscal year.
