When appointed by the Court, the Public Defender represents persons—primarily those charged with misdemeanor or felony criminal violations--when the Court has determined those persons cannot afford to hire an attorney.

The Public Defender may also be appointed to represent individuals in:

• Child Support Contempt Cases; and
• Cases brought before the Mental Health Board

​All applicants for representation by the Public Defender must file a Financial Affidavit with the Court demonstrating that they are unable to afford a private attorney.
